Racist actions have legal consequences

In South Africa, viral videos of racist incidents can lead to serious legal consequences. Laws like the Promotion of Equality and Prevention of Unfair Discrimination Act (PEPUDA), or Equality Act, forbid hate speech.

Additionally, the new Prevention and Combating of Hate Crimes and Hate Speech Act of 2023 makes hate speech a criminal offence punishable by imprisonment.

A common law crime, crimen injuria, can also be used to prosecute someone for publicly attacking another person's dignity. In short, these racist actions are not only socially wrong, but they are also a violation of South African law.
